These Terms of Service ("Terms") govern your use of the Canuck-Tax.ca platform (the "Service"), operated by ElevareAI Inc. ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
This Service is available to residents of Canada excluding Quebec.
1. IMPORTANT: We Do Not File Your Taxes
Canuck-Tax.ca is a tax calculation and planning tool only. It does not transmit, file, or submit your tax return to the Canada Revenue Agency (CRA) or any other tax authority.
Completing a calculation on the Service does not mean your taxes have been filed. You are solely responsible for taking the results generated by the Service and filing them yourself — for example, by entering the figures into the CRA's online services or by printing and mailing your return.
We are not liable for any penalties, interest, or consequences resulting from your failure to file your return correctly or on time.
2. No Professional Advice
The Service is a tool for self-preparation. We are not your accountant, tax preparer, or lawyer, and your use of the Service does not create a professional, advisory, or fiduciary relationship. For advice about your specific tax situation, please consult a qualified professional.
3. Your Responsibility for Accuracy
You are solely responsible for the accuracy and completeness of the information you enter into the Service. We are not responsible for audits, reassessments, penalties, or interest resulting from incorrect, incomplete, or inaccurate information that you provide.
4. Your Account
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating your account and keep it up to date.
5. Acceptable Use
You agree to use the Service only for lawful purposes and only to prepare tax calculations for yourself or for those you are authorized to assist. You may not attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service.
6. Subscriptions, Billing, and Refunds
Paid plans, billing, automatic renewal, cancellation, and refunds are governed by our separate Subscription & Refund Policy, which forms part of these Terms.
7. Limitation of Liability
To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or relating to the Service is limited to the amount you paid us for the Service in the 12 months preceding the claim. We are not liable for any indirect, incidental, or consequential damages, including tax penalties, interest, audits, or lost data resulting from your use of the Service.
8. Service Availability
We aim to keep the Service available and accurate, but we provide it "as is" and do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features with reasonable notice.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of the Province of Alberta.
10. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through a prominent notice on the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
